The General Assembly returned to work on May 26th. The Supreme Court determined that it would have about two months left to finish its work, though legislators are only planning to spend about three weeks at the Capitol. During that time legislators will need to tackle the state budget (requiring about $3 billion in cuts), the School Finance Act, and other legislative items. The vast majority of bills will not pass, but some will get the green light.

CMLA will focus its efforts on two priorities: remote online notarization and “covid-related” relief bills.

We have been working on remote online notary for several years. We (and a strong coalition of real estate industry interest groups) are advocating for a bill to give Colorado notaries the ability to perform these notarizations, while at the same time protecting consumer privacy. The bill passed the Senate and is on track to pass the House before legislators adjourn for the year.

We will also be engaging on several pieces of legislation that will be introduced in response to the Covid-19 crisis. Bills addressing paid leave, worker’s compensation, whistleblower protections, unemployment insurance, and homeowner relief will all be debated in the next few weeks. We (and other stakeholders) will work to convey to legislators that many federal protections already exist, that we need to avoid adding unnecessary confusion/hardship for borrowers and small businesses, and that we need to take the time to fully understand and consider the impact of any new legislation after the crisis ebbs.

The Legislative and Regulatory Affairs Committee (LARAC) meets monthly to review proposed legislation and regulatory developments. We routinely comment on legislative and regulatory proposals to state and federal agencies, are active members of the Mortgage Bankers Association (MBA) and we attend the MBA’s National Policy Conference to engage with the Colorado Delegation in Washington, D.C.
