Rick Accomazzo is one of the founders of Murr Accomazzo & Siler, PC, a Denver, Colorado law firm that started in 1992. His practice emphasizes mortgage banking, commercial litigation, real estate finance, and real estate. Rick heads the mortgage lending practice group of MAS consisting of Jamie Siler, Joseph Murr and Dan Delaney. The firm provides the entire range of legal services that mortgage lenders and brokers will typically ever need.

Rick has more than 32 years experience representing mortgage lenders, both as in-house and outside counsel. He has extensive litigation experience in the mortgage banking field, including class action defense, repurchase disputes, lender liability defense, pursuit of mortgage fraud perpetrators, title insurance disputes, and employment disputes. He regularly advises mortgage bankers and mortgage brokers in transactions such as loan documentation, correspondent agreements, sales of loans and loan servicing, and warehouse lending. He also renders advice on mortgage banking compliance matters, including compliance with CFPB regulations, the Real Estate Settlement Procedures Act, Truth in Lending Act, Equal Credit Opportunity Act, and fair lending. He has been involved in drafting Colorado legislation relating to mortgage lending and was an original member of the Colorado Mortgage Broker Rule Making Task Force. Rick has been selected as an arbitrator in major arbitrations involving mortgage banking, has been qualified as an expert witness in mortgage lending litigation, and frequently gives speeches to mortgage industry groups.

Mr. Kay began his legal career as a law clerk during law school to the Denver law firm of Zarlengo, Mott & Zarlengo. Following law school, he practiced as an associate attorney with McKie & Associates in Denver, focusing on civil litigation, securities law, banking law and bankruptcy. During that time, he also acted as a Panel Bankruptcy Trustee for the United States Trustee’s Office for the District of Colorado handling Chapter 7 Bankruptcy cases.

Mr. Kay then accepted a position as First Assistant Attorney General in the Tort Litigation Section of the Colorado Attorney General’s Office. He remained in that position for 13 years. While there, he helped create the State of Colorado’s self-insurance and litigation defense programs. He personally handled many of the large and high-profile civil jury trials for the State of Colorado, including the Berthoud Pass bus accident, the Amendment 2 constitutional challenge, and the Amendment 16 constitutional case. In addition, his practice included many employment, civil rights, and governmental immunity cases.

In April 1999 Mr. Kay left the Attorney General’s Office to return to private practice with the firm of Patterson, Nuss & Seymour, P.C. His practice there continued to focus on insurance defense related cases, including employment, civil rights defense and defense of governmental entities as well as insurance coverage and general insurance matters. In October, 2005, Mr. Kay took a position as General Counsel for Assurity Financial Services, LLC, a full service mortgage bank with over 600 employees and offices in nine states and doing business in 30 states, before re-entering private practice. He joined Archer Bay, then operating as the Denver office of Lynch and Robbins, in 2012.

Courtnee Kennedy graduated from the University of Colorado Law School. Shorty after passing the bar Courtnee joined the law firm Calvert & Calvert, P.C. to practice general areas of law including family law, estate planning and personal injury. In 1999, Courtnee was offered the opportunity assist with a nationwide mortgage licensing project, which set in motion a legal career focused exclusively on licensing and compliance.

Courtnee subsequently established her own practice working directly with lenders, brokers and servicers to assist with proper licensing, regulatory review and on-­‐going licensing maintenance. Courtnee is a member of CMLA's Legislative and Regulatory Affairs Committee to review pending legislation relevant to the industry.

Elizabeth S. Marcus is a senior attorney with Janeway Law Firm, P.C. with more than twenty-five years’ experience in the representation of financial institutions with a concentration in complex foreclosure, bankruptcy, real estate title issues and related litigation. Ms. Marcus is also experienced in the representation of creditors in the areas of commercial foreclosures, loan workouts and evictions. During her tenure as a lawyer, she has developed and presented in-house training for staff and associate attorneys and implemented procedural compliance with federal regulatory directives to clients. She has worked in conjunction with attorneys, public trustees and legislators in drafting and revising state legislation impacting the Colorado foreclosure process. Ms. Marcus has contributed to and edited articles for various trade publications including Servicing Management and the USFN Quarterly Update. She has been a panelist at the 2011 Colorado Real Estate Symposium, an instructor at continuing legal education seminars and training seminars for the Colorado Public Trustee’s Association and the seminars hosted by the U.S. Bankruptcy Court.

Ms. Marcus earned a Bachelor of Science degree in Journalism from the University of Colorado-Boulder in 1983 and a Juris Doctor degree from George Washington University, Washington, DC in 1986. She is licensed to practice law in the State of Colorado and is admitted to practice before the United States District Court for the District of Colorado and the United States Court of Appeals for the Tenth Circuit. Ms. Marcus is a member of the Colorado and Denver Bar Associations. She has an AV Preeminent Martindale Hubble Rating.
